Mark is an experienced litigator who focuses on explaining his clients’ cases to judges and juries. He represents prisoners and detainees who seek appropriate medical care or challenge other conditions of their confinement. He also represents people asserting their voting rights, employees who have been wrongfully discriminated against at their workplace, and victims of medical malpractice or catastrophic injury. He has been practicing law since 2006.
Mark earned his undergraduate degree in political science and philosophy from the University of Wisconsin – Madison. He began law school at U.C. Hastings College of the Law, and then transferred to Indiana University School of Law – Indianapolis, from which he received his J.D.
Mark is a past chair of the executive committee of the Civil Rights Section of the American Association of Justice, and is a member of the National Lawyers Guild, the National Police Accountability Project, and the Indianapolis Bar Association. He is admitted to practice in the State of Indiana, the United States Court of Appeals for the Seventh Circuit, and the United States District Courts for the Southern and Northern Districts of Indiana and the Western District of Michigan.
Mark also provides training, legal consultation, and other assistance to attorneys recruited to represent plaintiffs in civil prison-related claims pursuant to Local Rule 87. Recruited counsel and attorneys considering volunteering to accept an appointment are invited to reach out to Mark with questions.
Mark often works with co-counsel from across the country and around the state. He has worked with attorneys from the ACLU of Indiana, the National Women’s Law Center, the National Health Law Program, the National Immigrant Justice Center, the Chicago Lawyers’ Committee for Civil Rights, the Lawyers’ Committee for Civil Rights under Law, Mayer Brown, LLP, Americans United for the Separation of Church and State, and Fieger Law.
Mark’s reported cases include Lee v. Abbott, Case No. 14-2388-RLY-MJD, U.S. District Court for the Southern District of Indiana, consolidated on appeal with Baskin v. Bogan, 766 F.3d 648 (7th Cir. 2014) (cert. denied); and Parker v. Franklin County Community School Corp., 667 F.3d 910 (7th Cir. 2012). Mark also served as co-lead counsel in Stafford, C. Smith, and D. Smith v. Carter, et al., Case No. 1:17-cv-00289-JMS-MJD, U.S. District Court for the Southern District of Indiana, representing a class of prisoners seeking treatment for Hepatitis C.
